MacroFab, Inc. ("MacroFab," "we," "our," or "us") operates the MacroFab platform and website at macrofab.com (collectively, the "Services"). This Privacy Policy describes how we collect, use, disclose, and protect personal information, and explains the rights available to you under applicable US state privacy laws.

By using our Services, you agree to the collection and use of information as described in this policy. If you do not agree, please do not use the Services.

1. Information We Collect

We collect personal information in the following categories:

Account and Contact Information

When you register for an account or contact us, we collect your name, email address, phone number, job title, and company name.

Order and Design Information

When you submit a quote or place an order, we collect design files (including Gerbers, ODB++, native EDA files, and BOM spreadsheets), component specifications, order quantities, shipping addresses, and other manufacturing instructions you provide. Design files may contain information that is proprietary to you or your organization. We treat design files as confidential and do not use them for any purpose other than fulfilling your orders and improving the accuracy of our platform's automated analysis tools, subject to our Responsible AI policy.

Payment Information

Payment card and billing information is collected and processed by our third-party payment processor. MacroFab does not store full payment card numbers on our systems.

Usage and Technical Information

We automatically collect information about how you interact with our Services, including IP address, browser type, device identifiers, pages visited, features used, and timestamps. We use cookies and similar tracking technologies as described in Section 7.

Communications

When you contact us by email, phone, or through our platform, we retain records of those communications.

Information from Third Parties

We may receive information about you from third-party sources such as business data providers, analytics partners, and referral services, which we combine with information we have collected directly.

2. How We Use Your Information

We use the personal information we collect for the following purposes:

Providing and improving the Services — processing quotes, orders, and payments; operating and maintaining platform features; and diagnosing technical issues.
Account management — creating and managing your account and authenticating your identity.
Communications — sending order confirmations, shipping updates, service announcements, and responses to your inquiries. With your consent, we may also send marketing communications, which you can opt out of at any time.
Analytics and product development — understanding how the platform is used in order to improve features and user experience, using aggregated or de-identified data where possible.
Legal compliance and safety — complying with applicable laws and regulations (including ITAR and export control requirements), enforcing our Terms of Service, detecting fraud, and protecting the rights and safety of MacroFab, our users, and the public.
Business operations — accounting, auditing, and other internal administrative purposes.

3. How We Share Your Information

MacroFab does not sell your personal information. We share personal information only in the following circumstances:

Manufacturing and fulfillment partners — we share order and design information with the contract manufacturers and logistics providers necessary to fulfill your orders. These partners are bound by confidentiality obligations and are not permitted to use your information for any other purpose.
Service providers — we engage third-party vendors to help operate our Services, including cloud infrastructure, payment processing, customer support, and analytics. These vendors act as service providers or processors and are contractually restricted from using your data for their own purposes.
Component suppliers and distributors — to source components for your orders, we share relevant BOM information (part numbers and quantities) with our supplier network. No identifying personal information is included beyond what is required to fulfill the order.
Legal and regulatory requirements — we may disclose personal information when required by law, subpoena, or other legal process, or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, or comply with export control and ITAR obligations.
Business transfers — in the event of a merger, acquisition, or sale of all or a portion of our assets, personal information may be transferred as part of that transaction. We will provide notice before your information becomes subject to a materially different privacy policy.
With your consent — we may share your information for other purposes with your explicit consent.

4. Your Privacy Rights

Depending on the state in which you reside, you may have some or all of the following rights regarding your personal information. MacroFab honors these rights for all US residents, regardless of your state of residence.

Right to Know / Access

You may request a copy of the personal information we hold about you, including the categories of information collected, the purposes for which it is used, and the categories of third parties with whom it is shared.

Right to Correction

You may request that we correct inaccurate personal information we hold about you.

Right to Deletion

You may request that we delete personal information we have collected about you, subject to certain exceptions (for example, information we are required to retain for legal, regulatory, or contractual reasons).

Right to Data Portability

You may request a copy of your personal information in a structured, commonly used, machine-readable format, where technically feasible.

Right to Opt Out of Sale or Sharing

MacroFab does not sell personal information. We do not share personal information for cross-context behavioral advertising. If this practice changes, we will update this policy and provide a clear opt-out mechanism.

Right to Opt Out of Targeted Advertising

You may opt out of the use of your personal information for targeted advertising. See Section 7 (Cookies and Tracking) for details on managing your preferences.

Right to Opt Out of Profiling

You may opt out of automated profiling that produces legal or similarly significant effects on you. MacroFab does not currently use personal information for decisions of this nature.

Right to Non-Discrimination

We will not discriminate against you for exercising any of your privacy rights. We will not deny you services, charge you different prices, or provide a lower quality of service because you exercised a right described in this policy.

California Residents — Additional Rights (CCPA / CPRA)

California residents have additional rights under the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA):

Right to Limit Use of Sensitive Personal Information — you may direct us to limit our use of sensitive personal information (such as account login credentials or precise geolocation) to purposes strictly necessary to provide the Services.
Shine the Light — California Civil Code Section 1798.83 permits California residents to request information regarding the disclosure of personal information to third parties for direct marketing purposes during the preceding calendar year. MacroFab does not share personal information with third parties for their direct marketing purposes.
To exercise your California rights, contact us as described in Section 9. We will respond to verifiable consumer requests within 45 days, with one possible extension of an additional 45 days where reasonably necessary.

Authorized Agents

You may designate an authorized agent to submit a rights request on your behalf. We may require written proof of authorization and may verify your identity directly before processing the request.

Appeal

If we decline to take action on a privacy rights request, you may appeal our decision by contacting us at the address in Section 9. We will respond to appeals within 60 days. If your appeal is denied, you may contact your state attorney general's office.

5. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this policy, unless a longer retention period is required or permitted by law. Factors we consider include:

The nature of the information and the sensitivity of any associated risk.
Legal, regulatory, and contractual obligations, including export control recordkeeping requirements.
The ongoing need to provide services, resolve disputes, and enforce agreements.

When personal information is no longer needed, we securely delete or de-identify it.

6. Data Security

MacroFab maintains administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. We maintain ISO 9001:2015 certification and our platform infrastructure is designed to industry-standard security practices. Design files are encrypted in transit and at rest.

No method of transmission over the Internet or electronic storage is completely secure. While we implement industry-standard measures, we cannot guarantee absolute security. If you become aware of a security issue related to your account, please contact us immediately.

7. Cookies and Tracking Technologies

We use cookies, pixel tags, and similar technologies to operate the Services, understand how you use them, and for analytics and advertising purposes. The categories of cookies we use include:

Strictly necessary — required for the platform to function, such as authentication and session management.
Analytics — help us understand how visitors interact with the site so we can improve it. We use aggregated, anonymized analytics data where possible.
Marketing — used to deliver relevant advertising and measure campaign effectiveness. These may involve third-party ad networks.

You can manage your cookie preferences through your browser settings or via the cookie preference center on our website. Disabling certain cookies may affect the functionality of the Services. To opt out of interest-based advertising, you may also visit optout.aboutads.info or optout.networkadvertising.org.

8. Children's Privacy

Our Services are not directed to individuals under the age of 16, and we do not knowingly collect personal information from children. If we learn that we have collected personal information from a child under 16, we will promptly delete it. 10. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors.
